7. Legal Bases for Processing
For processing governed by European data-protection law, we rely on the following legal bases.
Performance of a Contract
We rely on performance of a contract to process purchases and payments, fulfill orders, arrange delivery, provide order tracking and contractual after-sales services, provide an account you request, and take steps you request before entering into a purchase.
Legal Obligation
We rely on legal obligations for tax, accounting, transaction-record, regulatory, and other binding legal requirements.
Legitimate Interests
We rely on legitimate interests, balanced against your rights, for website and account security, fraud prevention, non-contractual customer inquiries, review moderation, dispute resolution, and establishing or defending legal claims.
Our legitimate interests include operating a reliable online store, protecting customers and transactions, providing useful customer feedback, and resolving problems.
Consent
We rely on consent for optional analytics, advertising tracking and cookies, promotional email subscriptions, and other optional processing that requires consent.
You can withdraw consent without affecting processing lawfully completed before withdrawal. You can object to processing based on legitimate interests as described below.
8. Cookies and Privacy Preferences
We use cookies and similar technologies for essential website functions, shopping sessions and carts, website security, optional functionality, analytics, performance measurement, and advertising.
Our CookieYes preference tool lets you accept or reject non-essential cookies, customize individual categories, and change previously saved choices.
Necessary cookies support website sessions, shopping carts, checkout, security, and remembering your privacy choices.
Non-essential cookies and tracking technologies remain disabled until you provide the relevant consent.
Closing or ignoring the cookie banner, scrolling, or continuing to browse does not constitute consent to non-essential tracking.
You can reopen cookie settings at any time. When you withdraw consent, subsequent consent-based collection through the affected technology stops.
Withdrawal does not automatically erase information collected before withdrawal. You can contact us to request deletion when the applicable requirements are met.
We remember your cookie preference for 180 days. After that period, we request your choices again.
We also request fresh consent before beginning a new consent-based purpose outside the choices you previously made.
Review our Cookie Policy for more information.
9. Advertising and Analytics
We use Google Ads and Meta Pixel to measure advertising performance and support advertising functions, subject to your consent.
These tools process information such as IP address, browser and device information, online and cookie identifiers, referral information, page and product views, add-to-cart events, checkout activity, purchase events, product information associated with an event, transaction value, and currency.
We use this information to understand advertising performance, attribute transactions to campaigns, measure conversions, and manage audiences based on permitted website activity.
We do not upload customer email addresses or telephone numbers to advertising platforms for customer-list matching.
We do not use enhanced conversions or advanced matching as described in this policy.
We do not transmit advertising events through server-side conversion integrations.
Advertising cookies and browser-based advertising events require the relevant consent. You can reject or withdraw advertising consent through our cookie settings.
Advertising platforms also process information under their own privacy notices and are not necessarily acting solely on our instructions.

10. Marketing Emails
We send promotional emails only to people who choose to subscribe.
Marketing emails include product information, store updates, promotional offers, and information relating to our newsletter subscription benefit.
Newsletter subscription is optional. Providing your email address when placing an order does not automatically enroll you in marketing.
A message intended to encourage completion of an abandoned purchase is treated as marketing and follows the relevant marketing permissions.
You can unsubscribe by using the unsubscribe link in the email or contacting info@aervyne.com.
We stop future promotional sends after your unsubscribe request is received and applied. A message already transmitted before your request is processed can still arrive.
We retain the minimum information needed to prevent further unwanted marketing.
Unsubscribing does not stop necessary communications concerning existing orders, payments, shipping, tracking, delivery, returns, exchanges, refunds, security, or customer service.
We do not send promotional SMS messages.
11. Who Receives Personal Information
We disclose personal information only as needed for the purposes described below.
Hosting and Technical Providers

Recipient information, products ordered, quantities, and necessary fulfillment and delivery instructions are processed to prepare, pack, and fulfill orders.
We fulfill orders using our own inventory operations and third-party fulfillment warehouses located in the United States. Fulfillment partners are not authorized by us to use customer delivery information for unrelated marketing.
Carriers and Tracking Providers
We use DHL and FedEx for transportation and delivery.
Recipient name, contact details, delivery address, shipment identifiers, delivery instructions, and delivery status are shared as needed for transportation, tracking, customs processing, delivery, and delivery support.

Providers processing information on our behalf are subject to appropriate contractual obligations and instructions.

12. Advertising Sharing and Opt-Out Choices
We do not sell or rent customer contact lists for money.
Disclosure of online identifiers and website activity to advertising platforms can fall within legal definitions of sale, sharing, or targeted advertising even when no money is exchanged for the information.
You can reject advertising cookies using our cookie settings.
You can also contact info@aervyne.com to object to advertising-related processing, ask questions about advertising data, or request assistance concerning information previously collected.
We do not knowingly sell or share personal information of children under 16 for cross-context behavioral advertising.
13. International Processing and Transfers
Aervyne LLC operates in the United States.
Our service providers process information in the United States and other locations used to provide website hosting, communications, payments, fulfillment, delivery, tracking, advertising services, and technical support.
Personal information can therefore be processed outside your country of residence, where privacy laws can differ.
For transfers subject to European data-protection restrictions, we use an applicable lawful transfer mechanism, including an applicable adequacy decision or appropriate safeguards such as approved standard contractual clauses.
The appropriate mechanism depends on the recipient and transfer involved. Additional protections are applied when required.
We do not rely solely on your use of aervyne.com or general acceptance of this Privacy Policy as authorization for international transfers.
Contact info@aervyne.com for information about relevant recipients, processing locations, and applicable safeguards, subject to appropriate protection of confidential information.
14. Retention of Personal Information
We retain personal information only for as long as needed for the purposes described in this policy or to satisfy legal obligations.
Account Information
Retained while your account remains active. Information no longer needed is deleted or anonymized within 30 days after an effective account closure or deletion request, except where continued retention is required.

Retained for 7 years under our business record-retention schedule.
European Order, Invoice, and Transaction Records
Necessary accounting and tax records are retained for up to 10 years.
Fraud and Security Investigation Records
Retained for up to 3 years after resolution, unless an unresolved legal claim or obligation requires longer retention.
Customer Service Records
Retained for 3 years after the matter is closed.
Return, Exchange, and Refund Supporting Records
Retained for 3 years after resolution, with longer retention for unresolved claims or legal obligations.
Marketing Subscription Information
Retained during the subscription. Necessary evidence of consent is retained for up to 3 years after withdrawal.
Unsubscribe Records
Retained for as long as needed to prevent unwanted marketing through the relevant program.
Identifiable Analytics Data Under Our Control
Retained for no longer than 13 months.
Cookie Preferences
Stored for 180 days.
Reviews and Uploaded Content
Retained while published. Following an effective deletion request, content is removed from normal-use systems within 30 days unless continued retention is legally justified.
Backups
Maintained on a rolling basis for up to 90 days.
Accounting retention does not mean every piece of information associated with an order is retained for the full accounting period. Information no longer needed is deleted or anonymized earlier.
Information associated with an unresolved dispute, investigation, or legal hold is retained for the relevant obligation and restricted to that purpose.
Deleted information can remain temporarily in backups until those copies expire. Backup information is not used to restart discontinued marketing, and deletion instructions are reapplied following restoration.
Independent providers apply their own retention rules to information they independently control.
15. Security
We use safeguards including HTTPS, encryption, access restrictions, access logging, appropriate account controls, and security procedures for website and transaction systems.
Access to personal information is limited to the work necessary to operate our store and provide our services.
We maintain procedures for investigating suspected security incidents, limiting their impact, and making notifications required by law.
No website, storage system, or transmission method can guarantee absolute security.
Please use a strong password for your account and avoid sending unnecessary sensitive information through email or contact forms.
If you believe your account or personal information has been compromised, contact info@aervyne.com.
16. Your Privacy Rights
Depending on the law governing the processing and your place of residence, you have rights to:
- Obtain information about our collection, use, and disclosure of personal information.
- Request access to your personal information.
- Correct inaccurate personal information.
- Request deletion.
- Receive a portable copy of qualifying information.
- Restrict certain processing.
- Object to processing based on legitimate interests.
- Withdraw consent.
- Opt out of covered sale, sharing, or targeted advertising.
- Challenge certain automated decisions when covered by applicable law.
- Appeal a privacy-request decision where provided by law.
- Submit a complaint to a competent regulator.
These rights are subject to applicable legal requirements and exceptions. An account-deletion request does not require us to delete information we are legally required to retain for tax, accounting, fraud-prevention, or unresolved legal claims.
If we cannot fulfill all or part of a request, we explain the reason. We do not discriminate against customers for exercising applicable privacy rights.
European Requests
For privacy requests governed by the GDPR, we respond without undue delay and within one month.
When the complexity or number of requests justifies an extension, we explain the reason within the initial one-month period. The permitted extension is up to an additional two months.
You also have the right to complain to a competent supervisory authority, including the authority where you live, work, or believe an infringement occurred.
U.S. Requests
State privacy rights depend on your state of residence, whether the relevant law applies to our processing, and the type of personal information and processing involved.
We respond within the applicable statutory period and explain any permitted extension or refusal.
To appeal a privacy decision, reply to our response or contact info@aervyne.com and identify the original request, the decision you are appealing, and your reason for requesting reconsideration.
17. How to Submit a Privacy Request
To submit a privacy request, contact info@aervyne.com.
Please include a description of your request, the email address associated with the relevant account, order, or communication, and information reasonably needed to identify the relevant records.
Account holders can also update available account information by signing in to their account.
For access or deletion requests, we use proportionate verification, such as checking the associated email address, order information, or account information.
We do not require unnecessary identity verification for an advertising opt-out request.
We do not request full payment card numbers, CVV/CVC codes, or full financial account credentials to verify a privacy request.
An authorized agent can submit a request on your behalf. When needed, we request reasonable evidence that the agent is authorized to act for you.
We communicate relevant correction, deletion, or preference changes to providers processing affected information on our behalf.
When a provider independently controls information, we explain the appropriate request channel and our role in assisting you.
18. Reviews and Customer Content
Reviews and photographs submitted for publication can be visible to other visitors to aervyne.com.
Please do not include delivery addresses, payment information, account credentials, private correspondence, or other unnecessary personal information.
We moderate customer submissions to address spam, fraud, unlawful content, and material unrelated to the shopping experience.
Submitting a product review does not automatically authorize us to use an identifiable photograph, testimonial, or review in paid advertising.
We obtain separate permission before using identifiable customer content for that purpose.
To request removal of customer content or withdraw permission for future advertising use, contact info@aervyne.com.
Withdrawal does not affect processing lawfully completed before withdrawal.
19. Children’s Privacy
Our activewear and sports apparel store is intended for a general adult audience and is not directed to children.
We do not knowingly collect personal information from children under 13.
We do not routinely collect birth dates or require identity documents solely to verify age.
If we learn that personal information was collected from a child without authorization required by law, we investigate and delete the information or take another appropriate action.
A parent or guardian can contact info@aervyne.com regarding a child’s personal information.
20. Automated Processing
Advertising services use permitted website activity to measure conversions, group interests, and support advertising selection.
Payment and security providers also supply information used in transaction-risk reviews.
We do not make our own final decisions to reject an order or restrict a customer account solely through automated processing. Relevant decisions receive human review.
If you want us to reconsider a decision affecting your order or account, contact info@aervyne.com.
Independent providers operate their own automated systems under their respective privacy notices.
21. External Services
aervyne.com includes integrations with and links to external websites and services.
When another provider independently collects or processes your personal information, that provider’s privacy notice applies to its activity.
Please review the relevant provider’s privacy information before submitting personal information through an external service.
Our Cookie Policy contains additional official references for the advertising, cookie-consent, and browser technologies used with our website.
22. Changes to This Policy
We update this Privacy Policy when our privacy practices, services, technology providers, processing purposes, or applicable requirements change.
The publication date at the top of this policy identifies the current published version.
For material changes affecting personal information, we provide an appropriate website notice or email notification.
When a new processing purpose requires consent, we request consent before beginning that processing.
Publishing a revised Privacy Policy does not, by itself, constitute consent to a new consent-based processing activity.
