About These Terms

Aervyne is operated by Aervyne LLC (“we,” “us,” or “our”).

These Promotional Terms apply to our Summer Special Event multi-item savings promotion, newsletter subscription discount, Free Standard Shipping offers, and other promotional benefits made available through aervyne.com.

By participating in or redeeming a promotion, you agree to these terms together with the specific conditions displayed with the offer.

1. Summer Special Event — Buy 2 and Save 10%

When you purchase 2 merchandise items in one order, you receive 10% off the qualifying merchandise.

• Both items need to be purchased in the same order.
• Separate orders cannot be combined.
• Different products or multiple units of the same product can qualify.
• The promotion is not limited to a product category unless the offer states otherwise.
• Shipping, taxes, duties, and other non-merchandise charges do not count as items.
• If cancellation or return leaves fewer than two items, the discount is recalculated under these Terms.
• A higher qualifying tier replaces this tier.
• This discount cannot be combined with another merchandise discount unless the offer states otherwise.
• Free Standard Shipping can still apply when the post-discount merchandise subtotal reaches the applicable threshold.

The benefit has no independent cash value.

2. Summer Special Event — Buy 3 and Save 15%

When you purchase 3 merchandise items in one order, you receive 15% off the qualifying merchandise.

• All three items need to be purchased in the same order.
• Separate purchases cannot be combined.
• Different products or multiple units of the same product can qualify.
• The 15% tier replaces the 10% tier; the discounts are not cumulative.
• If only two items remain after cancellation or return, the discount is recalculated at 10%.
• If fewer than two items remain, the order no longer qualifies for the Summer Special Event.
• This promotion cannot be combined with another merchandise discount unless expressly stated.

3. Summer Special Event — Buy 4 or More and Save 20%

When you purchase 4 or more merchandise items in one order, you receive 20% off the qualifying merchandise. This is the highest Summer Special Event tier.

• At least four items need to be purchased in the same order.
• Separate orders cannot be combined.
• Different products or multiple units of the same product can qualify.
• The 20% tier replaces the 10% and 15% tiers; the percentages are not added together.
• Buying more than four items does not increase the discount above 20% unless another tier is expressly offered.
• If the retained quantity falls to three items, the discount is recalculated at 15%; at two items, it is recalculated at 10%.
• Fewer than two retained items no longer qualify.

4. Summer Special Event Discount Tiers

The highest applicable tier replaces the lower tiers. Percentages cannot be added together, and separate orders cannot be combined. Unless another tier is expressly offered, 20% is the maximum discount under this promotion.

5. How Merchandise Items Are Counted

Each merchandise unit counts as one item. Different products, variations, and multiple units of the same product can be combined unless the offer states otherwise.

Separate orders cannot be combined. Shipping services, taxes, duties, fees, and other non-merchandise charges do not count.

Canceled, returned, refunded, or removed merchandise ceases to count toward the qualifying quantity.

6. Higher Summer Special Event Tier Takes Priority

When an order reaches a higher tier, that tier replaces the lower tier:

• 2 items: 10% off.
• 3 items: 15% off.
• 4 or more items: 20% off.

The percentages are not cumulative. Four items receive 20% off, not 10% + 15% + 20%.

7. Newsletter Subscription — 10% Off the Next Eligible Order

After subscribing to our newsletter, you can enjoy 10% off your next eligible order.

• The benefit applies once to the first qualifying order associated with the eligible subscription after subscribing.
• You do not need to be a first-time customer.
• The discount applies to merchandise only.
• Shipping, taxes, duties, customs charges, and other non-merchandise amounts are excluded.
• The Newsletter 10% Discount cannot be combined with the Summer Special Event or another merchandise discount unless expressly stated.
• Free Standard Shipping can apply when the post-discount merchandise subtotal reaches the applicable threshold.
• Canceling or returning the qualifying order does not automatically create another newsletter discount.
• Repeated subscriptions made solely to obtain additional discounts are not permitted.

The benefit has no independent cash value.

8. First Order After Subscription Eligibility

The Newsletter 10% Discount applies to the first eligible order placed after subscription.

Orders completed before subscription do not use or invalidate the benefit. Only one eligible post-subscription order receives the discount.

Once used, the same subscription does not provide another discount. Canceling or returning the qualifying order does not automatically restore it.

Reasonable customer, household, account, or subscription limits apply when needed to prevent promotional misuse.

9. Newsletter Promotion Exclusions

The Newsletter 10% Discount does not apply to shipping charges, sales taxes, VAT, import duties, customs charges, brokerage fees, carrier import-handling fees, or other non-merchandise charges.

Products or categories can be excluded only when that exclusion is clearly stated with the offer before purchase.

10. Free Standard Shipping — United States

Eligible U.S. orders receive Free Standard Shipping when the qualifying merchandise subtotal after discounts reaches USD $120.

• The threshold needs to be reached within one order.
• Separate orders cannot be combined.
• Shipping, taxes, duties, and other non-merchandise amounts do not count.
• The offer applies only to eligible Standard Shipping services and supported addresses in the contiguous United States.
• Expedited Shipping is separate and costs USD $7.99 per eligible order.
• If a discount reduces the qualifying subtotal below USD $120, Free Standard Shipping does not apply.

11. Free Standard Shipping — Supported European Destinations

Eligible orders to supported European destinations receive Free Standard Shipping when the qualifying merchandise subtotal after discounts reaches USD $200.

• The threshold needs to be reached within one order.
• Separate orders cannot be combined.
• Shipping, taxes, duties, customs charges, and other non-merchandise amounts do not count.
• The offer applies only to supported European destinations and eligible Standard Shipping services.
• Remote locations outside supported carrier routes are excluded.
• Expedited Shipping is separate and costs USD $7.99 per eligible order.
• If a discount reduces the qualifying subtotal below USD $200, Free Standard Shipping does not apply.

Free Standard Shipping does not include import VAT not collected at checkout, import duties, customs clearance charges, brokerage fees, or carrier import-handling charges.

12. Combining Promotions

Only one merchandise discount applies to an order unless a specific offer expressly allows combination.

• The 10%, 15%, and 20% Summer Special Event tiers cannot be combined; the highest qualifying tier replaces the lower tiers.
• The Newsletter 10% Discount cannot be combined with the Summer Special Event or another merchandise discount unless expressly stated.
• Free Standard Shipping can be combined with an eligible merchandise discount when the post-discount merchandise subtotal still reaches the applicable threshold.
• Orders cannot be artificially split, combined, or restructured to circumvent promotional rules.

13. How We Calculate Free Shipping Thresholds

Free Standard Shipping eligibility is based on the qualifying merchandise subtotal after merchandise discounts.

Shipping charges, sales taxes, VAT, import duties, customs charges, brokerage fees, carrier handling charges, and other non-merchandise amounts do not count toward the threshold.

14. Free Shipping After Discounts

A Summer Special Event discount, Newsletter 10% Discount, or another merchandise promotion can affect Free Standard Shipping eligibility.

If the merchandise subtotal reaches the threshold before a discount but falls below it afterward, Free Standard Shipping does not apply.

• Eligible U.S. orders need a post-discount qualifying merchandise subtotal of at least USD $120.
• Eligible European orders need a post-discount qualifying merchandise subtotal of at least USD $200.

15. Returns on Promotional Orders

Products purchased with a promotion remain subject to our Return & Exchange Policy and Refund Policy.

Refunds are calculated using the amount actually paid after discounts. The undiscounted product value is not refundable.

For an order-level discount, promotional value is allocated among the products according to the original order calculation.

Promotional discounts have no independent refundable cash value, and a refund does not exceed the amount actually paid for returned merchandise.

16. Partial Returns Under the Summer Special Event

If one or more items are returned, the merchandise retained can fall into a lower promotional tier.

• An order originally receiving 20% off is recalculated at 15% when three qualifying items remain.
• It is recalculated at 10% when two qualifying items remain.
• When fewer than two qualifying items remain, the retained merchandise no longer qualifies for the Summer Special Event.

The refund reflects the promotional value allocated to returned merchandise and any disclosed tier recalculation for merchandise retained. The total refund does not exceed the amount actually paid.

This calculation does not reduce statutory refund rights.

17. Returns on Newsletter Discount Orders

A refund reflects the amount actually paid after the Newsletter 10% Discount.

The discount has no separate refundable cash value. Returning all or part of the order does not automatically restore or transfer the newsletter benefit to another order.

Statutory refund rights remain unaffected.

18. Returns Affecting Free Standard Shipping

If a partial return reduces the retained merchandise subtotal below the original Free Standard Shipping threshold, we do not retroactively charge the original Standard Shipping fee or deduct it from the refund solely because the threshold is no longer met.

Return shipping responsibility is determined by the reason for return under our Return & Exchange Policy.

19. Order Cancellations

If you cancel an order that received a promotional benefit, the benefit does not automatically remain available for another purchase.

The same product price, Summer Special Event discount, Newsletter 10% Discount, Free Standard Shipping benefit, or product availability is not guaranteed for a replacement order.

A replacement order is subject to the promotional conditions in effect when it is placed.

20. Product Cancellations and Adjustments

If merchandise becomes unavailable or is canceled, we recalculate the remaining item quantity, applicable Summer Special Event tier, merchandise subtotal, and Free Standard Shipping eligibility.

Refunds for unavailable merchandise are based on the amount actually paid after discounts.

If the adjustment results from our error or inability to fulfill an item, we do not impose an undisclosed post-purchase shipping charge solely because the item was canceled.

21. Currency Conversion

When prices are displayed in a supported currency other than U.S. dollars, promotional amounts and Free Standard Shipping thresholds can be shown in that currency.

Exchange rates and rounding can create minor displayed differences. Currency conversion does not create eligibility when the underlying threshold has not been reached.

22. Taxes, Duties, and Other Charges

Promotional discounts and Free Standard Shipping do not eliminate sales taxes, VAT, import duties, customs charges, brokerage fees, customs clearance charges, carrier import-handling charges, or other government or third-party charges.

The recipient pays import-related amounts not collected by us as described in our Shipping Policy.

23. Newsletter Promotion Misuse

The Newsletter 10% Discount is intended for genuine subscribers.

Do not create multiple emails or accounts, repeatedly subscribe and unsubscribe, use variations of the same information, or use another person’s information solely to obtain additional discounts.

When the benefit is obtained through misuse, we invalidate it or cancel the affected order to the extent permitted by law.

24. Summer Special Event Misuse

The Summer Special Event is intended for genuine customer purchases.

We restrict, remove, or recalculate benefits where orders are artificially split or combined, quantities are manipulated, multiple tiers are claimed on the same merchandise, obvious errors are exploited, or fraudulent or abusive activity occurs.

25. General Promotion Misuse

We restrict, invalidate, remove, or cancel promotional benefits when a promotion is used contrary to its intended purpose.

If an affected order is canceled, the eligible refund is handled under our published policies and applicable law.

26. Pricing and Technical Errors

We work to ensure promotional discounts, quantity requirements, prices, and shipping thresholds are accurate.

An obvious typographical, pricing, calculation, configuration, or technical error does not create entitlement to an unintended benefit.

When an error materially affects an order, we correct the information, provide the correct terms, allow the order to continue under corrected terms with your agreement, or cancel the affected order and issue the applicable refund.

This does not limit consumer-protection rights.

27. Promotion Availability

The Summer Special Event and other promotional offers can be available for a limited period.

Subject to applicable law, we can modify, suspend, extend, replace, or discontinue an offer. Changes do not affect eligible orders validly completed before the change.

Adding merchandise to a cart does not reserve a promotional price, Summer Special Event tier, newsletter benefit, Free Standard Shipping eligibility, or inventory.

28. Product Availability

All promotions are subject to merchandise availability.

A promotion does not guarantee that a product, variation, size, quantity, or option remains available.

If merchandise becomes unavailable after an order is submitted, we cancel and refund the affected item under our policies.

Any resulting promotional recalculation follows Sections 16 and 20 of these Terms.

29. No Cash Alternative

Summer Special Event discounts, newsletter discounts, and Free Standard Shipping benefits have no independent cash value, cannot be redeemed for cash, cannot be sold or transferred, and cannot be converted into store credit solely because they were not used.

30. Additional Promotional Conditions

Individual promotions can include additional conditions shown in banners, promotional sections, newsletter communications, product pages, carts, landing pages, or other notices.

If a specific condition conflicts with these general Promotional Terms, the specific condition controls for that promotion to the extent of the conflict, provided it was clearly disclosed before purchase and does not reduce mandatory consumer rights.

31. Changes to These Promotional Terms

We update these Terms to reflect changes to promotions, website functionality, business practices, or applicable requirements.

The version in effect when you submit an eligible order applies to that order unless applicable law requires otherwise.
